Napolcom: Resolve cases vs errant cops in 60 days

MANILA, Philippines — The National Police Commission (Napolcom) said on Thursday that it has set a timeframe of 60 days for the conduct of summary dismissal proceedings against police officers facing administrative cases.

“This is justice with urgency. By setting clear timelines and holding everyone accountable to them, we ensure that complaints against police officers are resolved promptly—without delay, without injustice,” Napolcom Vice Chair and Executive Officer Rafael Vicente Calinisan said in a statement.

Based on the order signed on June 2 which took effect immediately, the initial evaluation of complaints must be completed within one working day.

On the other hand, the precharge investigation should start within two working days.

Respondents will have five working days to file their counter-affidavits, after which the investigation must be terminated within three working days, it said.

The investigation report and draft formal charge, if warranted, must be filed within five working days.

Once probable cause is found, the formal charge should be issued within one working day, and a hearing officer must be assigned within one working day.

Summons should be served within two working days, with the respondent required to file an answer within seven working days.

A prehearing conference must be conducted within three working days after receipt of the respondent’s answer.

Position papers are to be filed within seven working days, and a clarificatory hearing, if necessary, must be held within two working days.

The hearing officer should submit a report of investigation within seven working days, while the Napolcom en banc will have 14 working days to issue a decision.
